The Supreme court expressed its annoyance over the center for not framing a law, delineating guidelines, and enabling passive euthanasia. A Constitution bench said the Centre was passing the buck to the court. Centre has also submitted a response via its counsel stating that it had discussed and reflected on the issue and emphatically decided against passing a law in this regard.
In view of this, the Constitution bench may pass an order next week on the issue related to the lack of regulations to govern passive euthanasia and the right to die with dignity.
The judgment in 2018, had ruled that an adult can make a living will, which should be signed in the presence of two attesting witnesses and affirmed by the concerned judicial magistrate. In the case of the executor becoming terminally ill and going through prolonged medical treatment with no chance of recovery, the treating doctor needs to constitute a board consisting of experts in general medicine, cardiology, neurology, nephrology, psychiatry, or oncology with experience in critical care on the request of the family members.
